The following sweepstakes is intended for viewing in California and Nevada only and shall only be construed and evaluated according to California law. Longboards ice cream Trip Sweepstakes begins July 15, 2009 and ends December 31, 2009.

 

1. There Are Two Ways to Enter the Sweepstakes:

 

a. Online Entries:Enter online at www.raleys.com/Longboards. Entries must be received between 10:00 a.m. on July 15, 2009 and 11:59 p.m. on December 31, 2009. To enter online in the sweepstakes, you must enter your email address, street address including zip code and phone number in the online entry form at www.raleys.com/longboards. Limit one internet entry per email address. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning the email address or the domain associated with the submitted email address. Raley's, Bel Air Mart, Nob Hill General Store, Inc. and Warehouse Concepts (collectively "Sponsor") are not responsible for entries not received due to difficulty accessing the internet, service outage or delays, computer difficulties or other technological glitches.

 

b. Mailed Entries: To enter via mail, submit name, email address, street address including zip code and telephone number to the Raley's Marketing Department on a 3" by 5" index card to:

 

 

Mailed entries must be postmarked no later than December 22, 2009 and received no later than December 31, 2009. Sponsor assumes no responsibility for incomplete, damaged, misdirected, illegible, late, stolen or lost entries.

 

 

2. Eligibility Restrictions:

 

a. Open to legal residents of California and Nevada (in one of the following counties: Alameda, Alpine, Amador, Butte, Calaveras, Carson City, Churchill, Colusa, Contra Costa, Del Norte, Douglas, El Dorado, Elko, Fresno, Glenn, Humboldt CA, Humboldt NV, Lake, Lassen, Madera, Mariposa, Marin, Mendocino, Merced, Modoc, Mono, Monterey, Napa, Placer, Plumas, Sacramento, San Benito, San Francisco, San Joaquin, San Mateo, Santa Clara, Santa Cruz, Shasta, Sierra, Siskiyou, Solano, Sonoma, Stanislaus, Sutter, Tehama, Trinity, Tuolumne, Washoe, Yolo, Yuba) who are 18 years of age or older.  Void elsewhere and where prohibited by law. See below for additional eligibility restrictions. Employees of Sponsor affiliated entities, their affiliated advertising agencies, participating sponsors/promotional partners of Raley’s, Bel Air Mart, Nob Hill General Store, Inc., Warehouse Concepts (Food Source) and their immediate families or persons residing in the same household are not eligible to win.

 

b. Winner must show a government-issued photo ID showing date of birth in order to collect prize.

 

3. Prizes:

 

a. One (1) Grand Prize Winner will receive a trip for two (2) to Costa Rica in spring of 2010 including the following: round trip air fare departing from either Sacramento, Reno, Oakland or San Francisco International Airports, 5 night accommodations, surf lessons, board rental and daily breakfasts with a total estimated value of $10,000. Transportation to the departing airport is the responsibility of the winner.

 

b. The Grand Prize will be redeemable on any date between April 1 and April 30, 2010 or on a mutually agreed upon date by the prize winner and Longboards Ice Cream. The winner and guest will need to hold a traveling passport by departure date to redeem the prize. The Longboards Ice Cream Costa Rica Surf Trip Sweepstakes is intended for adults 18 years of age or older.

 

c. Odds of winning depend upon the number of eligible entries received.

 

d. There is no substitution, transfer, or cash equivalent for prizes, except that Sponsor may, at its sole discretion, substitute prizes of comparable value or cash. The prizes are expressly limited to the item(s) listed above and do not include taxes, gratuities or any other expenses.

 

4. Selection of Winners:

 

a. Decisions of Raley's Marketing Department with respect to the sweepstakes are final.

 

b. No later than January 15, 2009 the winners will be selected via random selection from all eligible entries received by the deadline.

 

c. The winner will be notified by email or telephone on or after January 15, 2010. In the event the potential winner does not respond to prize notification within 5 (five) days of attempted notification or declines the prize, another winner will be randomly chosen from the remaining eligible entrants.

 

5. Conditions:

 

a. Payments of all federal, state and local taxes on prizes are solely the responsibility of the winner. Winner may be required to sign an IRS Form W-9 or the equivalent.

 

b. Except where prohibited by law: (i) entry constitutes permission for Sponsor to use winner's entry, name, hometown, likeness, photograph, voice and statements regarding this sweepstakes for editorial, public relations, promotional and advertising purposes in any media, including the Internet, for any purpose whatsoever on behalf of Sponsor without compensation; (ii) each potential winner will be required to complete and return an Affidavit of Eligibility, Release of Liability and Publicity Release within five (5) days of notification or an alternate winner will be selected via random drawing from all remaining eligible entries. If winner notification is returned as undeliverable, prize will be forfeited and awarded to an alternate winner selected via random drawing from all remaining eligible entries. By participating and winning a prize, winner releases Sponsor, its parents, affiliates, subsidiaries, and agencies and their respective directors, officers, employees and agents from any and all liability with respect to the prize won and participation in the sweepstakes.

 

c. Sponsor assumes no responsibility for entries it is unable to process due to network, hardware or other technical failures; or any other reason, or incomplete, damaged, misdirected, illegible or lost entries. Sponsor reserves the right, in its sole discretion, to disqualify any person tampering with the entry process or the operation of the Sponsor's Websites or that is otherwise in violation of the rules. Sponsor further reserves the right to cancel, terminate or modify the sweepstakes if it is not capable of completion as planned, including infection by computer virus, technical corruption, unauthorized intervention, technical failures of any sort or force majeure. In the event of cancellation, Sponsor reserves the right to award the prize to eligible, non-suspect, entries received prior to date of cancellation. The use of automated entry devices or any other conduct that impedes the integrity of the sweepstakes is prohibited.

 

d. Sponsor reserves the right to make changes in the rules of the sweepstakes, including the substitution of a prize of comparable value.

 

e. Failure to comply with these Official Rules may result in a participant's disqualification, at the sole discretion of Sponsor. Participants agree that Sponsor is not liable for injuries, losses or damages of any kind arising from participation in this sweepstakes or acceptance, possession or use of prizes.

 

f. Sponsor is not responsible for typographical or other errors in the printing, the offering or the administration of the sweepstakes, or in the announcement of a prize.

 

g. For a list of all winners, available after February 28, 2010 mail a self-addressed, stamped envelope to: Trip Sweepstakes List Request, P.O. Box 15618, Sacramento, CA 95852.

 

6. Internet Privacy Policy: By use of this website and by entering the sweepstakes, you agree to Sponsor's Website Privacy Policy and to the use of your personal information as described in the Privacy Policy located at raleys.com/privacy.jsp and nobhill.com/privacy.jsp.

 

7. Liability Agreement: By entering, entrant agrees to follow the Official Rules and hold harmless and indemnify Raley’s & Bel Air, and/or each of their respective parents, subsidiaries, affiliates, directors, officers, employees and agents against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant’s participation; or (ii) the receipt or use of the prizes awarded in the promotion.
