The following sweepstakes is intended for viewing in California and Nevada only and shall only be construed and evaluated according to California and Nevada laws.
1. How to Enter the Sweepstakes:
a. The Raley’s Backyard Party Sweepstakes begins July 24, 2009 and ends August 14, 2009.
b. Online Entries: Enter online at www.raleys.com/backyard Entries must be received between 10:00 a.m. on Friday, July 24, 2009 and 11:59 p.m. on Friday August 14, 2009. To enter online, the participant must enter his or her valid email address, phone number and zip code in the online entry form. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning the email address or the domain associated with the submitted email address.
c. Mailed Entries: Print entry form at www.raleys.com/backyard. Entries must be completed with valid email address, phone number and zip code. forms must be mailed to: Attn: Raley’s Backyard Party Sweepstakes, 500 West Capitol Avenue, West Sacramento, California 95605. Sponsor assumes no responsibility for incomplete, damaged, misdirected, illegible, late, stolen or lost entries. Mailed entries must be postmarked no later than August 14, 2009 and received no later than August 17, 2009. Mailed entries not postmarked and received by these dates are not eligible to win the Grand Prize.
2. Eligibility Restrictions:
a. The sweepstakes is open to legal residents of California and Nevada (in one of the following counties: Alameda, Alpine, Amador, Butte, Calaveras, Carson City, Churchill, Colusa, Contra Costa, Del Norte, Douglas, El Dorado, Elko, Fresno, Glenn, Humboldt CA, Humboldt NV, Lake, Lassen, Madera, Mariposa, Marin, Mendocino, Merced, Modoc, Mono, Monterey, Napa, Placer, Plumas, Sacramento, San Benito, San Francisco, San Joaquin, San Mateo, Santa Clara, Santa Cruz, Shasta, Sierra, Siskiyou, Solano, Sonoma, Stanislaus, Sutter, Tehama, Trinity, Tuolumne, Washoe, Yolo, Yuba) who are 18 years of age or older at time of entry are eligible to enter except employees of Raley’s, Bel Air Mart, Nob Hill General Store, Inc., Warehouse Concepts dba (Food Source), their affiliates, subsidiaries (collectively “Sponsor”) and members of their immediate families or persons residing in the same household are not eligible to enter or win.
3. Prize:
a. Grand Prize - One (1) grand prize winner and winner’s 19 guests will receive a Backyard including food and non-alcoholic beverages (menu subject to Sponsor’s discretion) for twenty (20) people and a $250 Raley’s gift card. No transportation will be provided to winner or their guests. Total approximate retail value is $600. Winner will be selected in a random drawing from among all eligible entries received. No prize substitution or alternative prize will be allowed except as provided herein. Sponsors reserve the right to substitute a prize of equal or greater value should the advertised prize be unavailable.
b. Odds of winning depend on the actual number of valid entries received.
4. Selection of Winner:
a. Decisions of Raley's Marketing Department with respect to the sweepstakes are final.
b. No later than August 17, 2009, the winner will be selected via random selection from eligible entries received by the deadlines.
c. Prize winner will be notified on or about August 17, 2009. Winner must respond to prize notification within five (5) days of notification or another winner will be randomly chosen from the remaining eligible entrants.
5. Conditions:
a. Entries received via mail must be handwritten. No ink stamps or address labels allowed. No reproductions of entry blanks accepted.
b. Limit one entry per household.
c. All federal, state and local taxes, if any, are the responsibility of the winner.
d. Except where prohibited by law: (i) entry constitutes permission for Sponsor to use winner’s name, hometown, likeness, photograph, voice and statements regarding this sweepstakes for editorial, public relations, promotional and advertising purposes in any media, including the Internet, for any purpose whatsoever on behalf of Sponsor without compensation; (ii) each potential winner will be required to complete and return an Affidavit of Eligibility, Winner’s Agreement and Release within three (3) days of notification. If winner notification is not returned or is returned as undeliverable, prize will be forfeited and another name will be drawn. By participating in the sweepstakes and winning the prize, winner releases Sponsor, its parents, affiliates, subsidiaries, and agencies and their respective directors, officers, employees and agents from any and all liability with respect to the prize won and participation in the sweepstakes. Sponsor assumes no responsibility for entries it is unable to process due to network, hardware or other technical failures; or any other reason, or incomplete, damaged, misdirected, illegible or lost entries.
e. Sponsor reserves the right, in its sole discretion, to disqualify any person tampering with the entry process or the operation of the Sponsor's Websites or that is otherwise in violation of the rules. Sponsor further reserves the right to cancel, terminate or modify the sweepstakes if it is not capable of completion as planned, including infection by computer virus, technical corruption, unauthorized intervention, technical failures of any sort or force majeure. In the event of cancellation, Sponsor reserves the right to award the prize to eligible, non-suspect, entries received prior to date of cancellation. The use of automated entry devices or any other conduct that impedes the integrity of the sweepstakes is prohibited.
f. Sponsor reserves the right to make changes in the rules of the sweepstakes, including the substitution of a prize of comparable value.
g. Failure to comply with these Official Rules may result in a participant's disqualification, at the sole discretion of Sponsor. Participants agree that Sponsor is not liable for injuries, losses or damages of any kind arising from participation in this sweepstakes or acceptance, possession or use of prizes.
h. Sponsor is not responsible for typographical or other errors in the printing, the offering or the administration of the sweepstakes, or in the announcement of a prize.
i. For a list of all winners, available after September 1, 2009, mail a self-addressed, stamped envelope to: Raley’s Backyard Party Sweepstakes List Request, P.O. Box 15618, Sacramento, CA 95852 for receipt by October 31, 2009.
6. Internet Privacy Policy:
By use of this website and by entering the sweepstakes, you agree to Sponsor's Website Privacy Policy and to the use of your personal information as described in the Privacy Policy located at raleys.com/privacy.jsp and nobhill.com/privacy.jsp.
7. Liability Agreement:
By entering, entrant agrees to follow the Official Rules and hold harmless and indemnify Sponsor against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant’s participation; or (ii) the receipt or use of the prizes awarded in the promotion.
