Official Rules and Regulations

The following contest is intended for viewing in California and Nevada only and shall only be construed and evaluated according to California law.

 

1.    How to Enter the Contest:

 

a.    The 2009 National Beef Cook-Off is held on September 21 - 23, 2009. 

 

b.    Online Entries:  Enter online at www.raleys.com/beefitup. Entries must be received between 5:00 p.m. on Wedesday, August 19, 2009 and 12:00 p.m.on Friday, September 11, 2009. To enter online, entrant must enter his or her valid email address, mailing address, phone number in the online entry form. Internet entries will be deemed made by the authorized account holder of the email address submitted at the time of entry. The authorized account holder is the natural person who is assigned to the email address by an internet access provider, online service provider or other organization that is responsible for assigning the email address or the domain associated with the submitted email address. 

 

c.     Mailed Entries:  Print entry form at www.raleys.com/beefitup. Entries must be completed by entrant with valid email address, mailing address, and phone number. Entry forms must be mailed to: Marketing, Beef it Up , 500 West Capitol Avenue, West Sacramento, California 95605.  Sponsor assumes no responsibility for incomplete, damaged, misdirected, illegible, late, stolen or lost entries. Mailed entries must be postmarked no later than September 7, 2009 and received no later than September 10, 2009.  Mailed entries not postmarked and received by these dates are not eligible to win Prizes.  

 

By entering the Contest, entrants agree to assign their intellectual property rights to Sponsor and permit Sponsor to use the entries in any media, including the Internet, for commercial, promotional or any other purpose whatsoever. Entrants who do not agree to this use should not enter this contest.

 

2.    Eligibility Restrictions:

 

a.    Open to legal residents of California and Nevada (in one of the following counties: Alameda, Alpine, Amador, Butte, Calaveras, Carson City, Churchill, Colusa, Contra Costa, Del Norte, Douglas, El Dorado, Elko, Fresno, Glenn, Humboldt (CA), Humboldt (NV), Lake, Lassen, Madera, Marin, Mariposa, Mendocino, Merced, Modoc, Mono, Monterey, Napa, Placer, Plumas, Sacramento, San Benito, San Francisco, San Joaquin, San Mateo, Santa Clara, Santa Cruz, Shasta, Sierra, Siskiyou, Solano, Sonoma, Stanislaus, Sutter, Tehama, Trinity,

Tuolumne, Washoe, Yolo, Yuba) who are 18 years of age or older at the time of

entry. Employees of Kellogg North America Company, Raley's, Bel Air Mart, Nob

Hill General Store, Inc., Warehouse Concepts (Food Source), their affiliates,

subsidiaries, partners, advertising and promotion agencies and their immediate

family members and/or those living in the same household of each are not eligible to

participate. All federal, state and local laws and regulations apply. Void where

prohibited. 

 

b.    Only one winner per household is permitted.

 

3.    Prizes:

 

a.    One (1) Grand Prize Winner will receive – Two (2) admission tickets to attend the Home Cook’s Cook-Off on September 21 -23, 2009, Hotel accommodations for three (3) nights and $2,000 gift card at Raley's, Bel Air or Nob Hill Foods. Grand Prize Winner will be required to provide their own transportation.

Three (3) First Place Winners will receive a $500 gift card to Raley's, Bel Air or Nob Hill Foods. 

 

The awarding of any prize is contingent upon full compliance with these Official Rules; winner may be subject to other verification and eligibility requirements. Entrants agree to be bound by Official Rules and agree that if potential winner fails to provide proof of identity, refuses to provide required affidavit, is found to have violated Official Rules or otherwise does not meet eligibility criteria. That winner’s prize will be forfeited and awarded to the entry with the next highest score. Entrants agree that Sponsor is not liable for injuries, losses or damages of any kind arising from participation in this contest or acceptance, possession or use of prizes.

 

b.    All prizes are non-transferable. No prize substitution or alternative prize will be allowed except as provided herein.  

 

c.    Odds of winning depend on the actual number of valid entries received.<br />

 

4.    Selection of Winner:

 

a.    Decisions of Raley's Marketing Department with respect to the sweepstakes are final.

 

b.   The Grand Prize winner will be notified on or about September 14, 2009. First Place Winners will be notified on or about September 30, 2009. Winners must respond to prize notification within five (5) days of notification or that winner’s prize will be awarded to the next entrant selected.

 

5.    Conditions:    

 

a.    Entries received via mail must be handwritten. No ink stamps or address labels allowed. No reproductions of entry blanks accepted.

 

b.    All federal, state and local taxes, if any, are the responsibility of the winner.

 

c.    Except where prohibited by law: (i) entry constitutes permission for Sponsor to use winner’s name, hometown, likeness, photograph, voice and statements regarding this sweepstakes for editorial, public relations, promotional and advertising purposes in any media, including the Internet, for any purpose whatsoever on behalf of Sponsor without compensation; (ii) each potential winner will be required to complete and return an Affidavit of Eligibility, Winner’s Agreement and Release within five (5) days of notification.  If winner notification is not returned or is returned as undeliverable, prize will be forfeited and awarded to the entrant with the next highest score.  By participating in the sweepstakes and winning the prize, winner releases Sponsor, its parents, affiliates, subsidiaries, and agencies and their respective directors, officers, employees and agents from any and all liability with respect to the prize won and participation in the sweepstakes. Sponsor assumes no responsibility for entries it is unable to process due to network, hardware or other technical failures; or any other reason, or incomplete, damaged, misdirected, illegible or lost entries.

 

e.    Sponsor reserves the right, in its sole discretion, to disqualify any person tampering with the entry process or the operation of the Sponsor's Websites or that is otherwise in violation of the rules. Sponsor further reserves the right to cancel, terminate or modify the sweepstakes if it is not capable of completion as planned, including infection by computer virus, technical corruption, unauthorized intervention, technical failures of any sort or force majeure. In the event of cancellation, Sponsor reserves the right to award the prize to eligible, non-suspect, entries received prior to date of cancellation. The use of automated entry devices or any other conduct that impedes the integrity of the sweepstakes is prohibited.

 

f.    Sponsor reserves the right to make changes in the rules of the sweepstakes, including the substitution of a prize of comparable value.

 

g.    Failure to comply with these Official Rules may result in a participant's disqualification, at the sole discretion of Sponsor. Participants agree that Sponsor is not liable for injuries, losses or damages of any kind arising from participation in this sweepstakes or acceptance, possession or use of prizes.

 

h.    Sponsor is not responsible for typographical or other errors in the printing, the offering or the administration of the sweepstakes, or in the announcement of a prize.

 

i.    For a list of all winners, available after November 30, 2009, mail a self-addressed, stamped envelope to: Marketing, Beef it Up Contest Winner List, P.O. Box 15618, Sacramento, CA 95852.

 

6.      Internet Privacy Policy: By use of this website and by entering the sweepstakes, you agree to Sponsor's Website Privacy Policy and to the use of your personal information as described in the Privacy Policy located at raleys.com/privacy.jsp and nobhill.com/privacy.jsp.

 

7. Liability Agreement:  By entering, entrant agrees to follow the Official Rules and hold harmless and indemnify Sponsor against any and all liability, damages or causes of action (however named or described), with respect to or arising out of either (i) entrant’s participation; or (ii) the receipt or use of the prizes awarded in the promotion.
